Boy hit by truck awarded $1.5 million

WILKES-BARRE—A 14-year-old boy who was hit by a Ford Bronco in 1996 was awarded $1.5 million Friday in a verdict from Luzerne County Court of Common Pleas Judge Peter Paul Olszewski Jr.

John Derby, who was represented by Robert Powell, was 9 when he was struck by a 1986 Ford Bronco driven by William Ebert Jr. on South Poplar Street in Hazleton. Derby was crossing the street when the impact occurred and was propelled into a Mercury Cougar, said Neil 0'Donnell, attorney for Michelle Holloman, Derby's mother.

Derby had to be extricated from under the car, O'Donnell said. He continues to suffer from residual injuries.

Holloman, who was being sued by Ebert for negligence, was completely vindicated, court papers state. Ebert was found 100 percent liable.
